Who it is for

For a photographer, brand, agency or studio that books a model, and for the model, who want the shoot, safety, fee and use of the images in writing, with a parent or guardian signing for a minor.

Rules on image rights, on modelling work, on nudity and on minors differ by country; a minor’s agreement must be signed by a parent or guardian, who is added as a further party.

What it covers

13 clauses, in this order. Each one is in the sample text below, and you can edit, remove or add clauses before you send.

  • 1. Purpose

    What the agreement is for: the Model works for the Client at the shoot below, and how the Client may use the resulting images.

  • 2. The shoot

    Blanks for the shoot, date, place, hours and who is present. Set daily hours and breaks apply, extra work needs the Model’s agreement and is paid at a rate in a blank, and no one else attends without the Model’s agreement.

  • 3. Conduct, safety and boundaries

    The Client provides a safe, private place to change, water and rest, asks for no alcohol or drugs and allows no pressure. The Model may stop at any time. No nudity or intimate content unless agreed beforehand and named in a blank.

  • 4. Fee and expenses

    The fee comes from the price schedule. Agreed expenses are paid at cost against receipts. The fee covers only the uses of the images stated in the agreement.

  • 5. Use of the images

    Blanks for purpose, media, territory and duration. A non-exclusive permission; the Client owns the images but not the Model’s rights in its likeness, name and voice. Other uses need the Model’s consent.

  • 6. Editing and limits on use

    Usual retouching only: no change to body shape or identity the Model has not agreed to, no face-swapping, no false or demeaning use, no suggested endorsement, and no synthetic copies of the Model unless a blank allows it.

  • 7. Approval of images

    The Client shows the Model the selected images before the first publication. A blank says whether the Model has a right to object to specific images within a set time.

  • 8. Credit and portfolio

    The Model is credited as a blank says where credits are customary. The Model may use a set number of the images in its own portfolio and online from a date in a blank, crediting the photographer and the Client.

  • 9. Minors and guardians

    For a person under a set age, or too young to sign alone where they live, a parent or guardian signs as a further party, named in a blank, and attends the shoot. Never nudity for a minor. The rules on work by minors apply.

  • 10. Cancellation and postponement

    If the Client cancels or postpones on short notice, it pays a share of the fee. If the Model is ill or has an emergency, they agree a new date. Weather or other causes beyond both sides move the shoot free of charge.

  • 11. Personal data and withdrawal

    Images and details of the Model are handled as the law requires. The Model may withdraw permission for future uses on notice, with limits in a blank; the Client then stops new uses and removes the images from its own channels.

  • 12. Insurance, liability and independence

    A blank names the Client’s insurance, and the Client is responsible for safety at the place. Liability is capped by a blank, with the legal exceptions. The Model is independent as far as the law allows; legal protections stay.

  • 13. Governing law and disputes

    The law you name applies. The sides first try to settle a dispute in good faith, and otherwise the courts you name decide.

A price schedule (items, quantities and prices) is part of this contract. It starts empty, in your currency, and the clauses on fees and payment point to it.

Modelling Agreement

Parties: Client · Model

1. Purpose

This agreement sets out the terms on which the Model works for the Client at the shoot described below, and how the Client may use the resulting images of the Model.

2. The shoot

Shoot: [[Description of the shoot or campaign, e.g. a fashion catalogue, a product campaign, a portfolio shoot]]

Date and place: [[Date, call time and place]]

The shoot lasts up to [[8]] hours a day, including hair, make-up and styling, with a break of at least [[1]] hour after [[5]] hours and short breaks whenever the Model needs them. Work beyond that is done only with the Model’s agreement and is paid at [[Overtime rate]].

People present: [[Photographer, stylist and others who will be present]]. No one else is present at the shoot without the Model’s agreement.

3. Conduct, safety and boundaries

The Client treats the Model with respect and provides a safe, clean and private place to change, drinking water and a place to rest. The Client does not ask the Model to drink alcohol or take drugs and does not allow harassment or pressure of any kind. The Model may stop, take a break or leave if it feels unsafe or uncomfortable, and may bring a companion to the shoot.

The shoot does not include nudity, partial nudity or intimate or sexual content, unless the Model has agreed to it in writing or in electronic form before the shoot and it is named here: [[none / the content agreed]]. The Model may withdraw its agreement to such content at any time during the shoot.

4. Fee and expenses

The Client pays the fees shown in the price schedule of this contract. Agreed expenses, such as travel and meals, are paid at cost against receipts. The fee covers the uses of the images stated under Use of the images and no others.

5. Use of the images

The Model allows the Client to use the images from the shoot in which the Model appears within these limits:

This permission is non-exclusive. The Client owns the images, but the Model’s own rights in its likeness, name and voice are not transferred. A use outside these limits needs the Model’s consent in writing or in electronic form and may carry a further fee.

6. Editing and limits on use

The Client may crop the images and retouch them in the way that is usual for the kind of work, such as colour, light and blemishes. It does not change the Model’s body shape, skin colour or other identifying features in a way the Model has not agreed to, does not put the Model’s face on another body or another person’s face on the Model, and does not show the Model in a false or demeaning way. The Client does not use the images to suggest that the Model endorses a product, a political view or a cause other than those named under Use of the images.

The Client does not use the images to train, test or create a synthetic image, video or voice of the Model: [[no exception / the exception agreed]]

7. Approval of images

Before the first publication the Client shows the Model the images selected for use.

8. Credit and portfolio

The Client credits the Model as [[the credit wording, e.g. the Model’s name or handle / no credit]] where credits are customary. The Model may use up to [[10]] of the images in its own portfolio and on its own website and social media from [[the date of first publication / the date of delivery]], crediting the photographer and the Client as [[the credit wording]].

9. Minors and guardians

If the Model is under [[18]] years old, or under the age at which it can sign for itself where it lives, a parent or legal guardian also signs this agreement as a further party, confirms that they have the authority to sign for the Model and agrees to the shoot and to the use of the images. Parent or guardian: [[Name of parent or guardian and relationship]]

A parent or guardian, or a person they name, is present at the whole shoot. The shoot never includes nudity or intimate content for a minor. The Client follows the rules that apply to work by minors, such as hours, breaks, schooling and any permit that is required, and pays fees for a minor as the law that applies requires.

10. Cancellation and postponement

If the Client cancels or postpones the shoot on less than [[48]] hours’ notice, it pays [[50]]% of the fee. If the Model cannot attend because of illness or an emergency, it tells the Client without delay and the parties agree a new date. A shoot that cannot take place because of weather or other causes beyond the control of both parties is moved to the next date that suits both, without charge. Further claims are excluded as far as the law allows.

11. Personal data and withdrawal

The images and the information about the Model may be personal data. The Client handles them as the law that applies to it requires, uses them only for the purposes in this agreement, keeps them only as long as needed and tells the Model on request how they are stored and used.

The Model may withdraw its permission for future uses on [[30]] days’ notice in writing or in electronic form. Limits on withdrawal: [[e.g. it does not affect copies already printed or distributed or uses already made]]. After a withdrawal the Client makes no new use of the images and, where reasonably possible, removes them from its own website and social media within [[30]] days. Rights that the law gives the Model, for example under privacy and data protection law, remain unaffected.

12. Insurance, liability and independence

The Client has [[the insurance that applies to the shoot, e.g. public liability insurance / no special insurance]] and is responsible for the safety of the place of the shoot. Except for intent, gross negligence, personal injury or where the law does not allow a limitation, each party’s total liability under this agreement is limited to [[the fees paid or payable under it / a fixed amount]].

As far as the law that applies allows, the Model is an independent person and not an employee of the Client; protections that the law gives to models and to workers stay as they are.

13. Governing law and disputes

This agreement is governed by the law stated under Governing law. The parties will first try to settle any dispute in good faith. Otherwise the courts stated under Jurisdiction decide, unless mandatory law provides otherwise.

What it is, and what it is not

QuoteBill creates a simple electronic signature with an audit trail. In the EU, the UK, the US and Korea a signature is not denied legal effect only because it is electronic, and in Japan most contracts need no particular form at all. What a simple electronic signature proves in a dispute depends on the evidence behind it, and some documents need another form.

It is not a qualified or advanced electronic signature, and QuoteBill does not verify who the signers are. It records the use of the link and access code you delivered, so anyone who has both can sign. The signature certificate lists every link issued and, for each action by the sender or a signer, its IP address and browser where they could be read.

Some documents need another form. Wills, many real-estate transfers, guarantees and some employment documents must, in some countries, be handwritten, notarised or signed with a qualified signature. The templates are samples, not legal advice: review them with a lawyer.
