Who it is for

For a private tutor or music or language teacher and a student or parent who want lessons, schedule, cancellation, payment and safety arrangements written down before lessons begin.

A guardian signs for a minor. Rules on tutoring children, safeguarding, taxes and whether a tutor counts as self-employed or as staff differ by country; check local law.

What it covers

  • 1. Purpose

    What the agreement is for: the Tutor gives private lessons to the Student, who may be an adult or a minor. For a minor, a parent or legal guardian signs as a further party.

  • 2. The lessons

    Blanks for the subject, level and goals, number and length of lessons, start date, place or online form and language.

  • 3. Schedule and attendance

    A blank for the regular day and time. The Student arrives on time and prepared; a late start is not made up unless the Tutor can carry on. A Tutor who is very late without notice makes up the lesson or does not charge it.

  • 4. Cancellation and make-up lessons

    Free cancelling up to a set number of hours before; after that the lesson is charged, but an ill Student gets a make-up. If the Tutor cancels, a make-up is offered or the lesson is not charged and a paid fee comes back.

  • 5. Fees and payment

    Fees come from the price schedule, per lesson, month or block, and are billed at a set time by the Student or the signing parent or guardian. Travel and materials are charged only if listed or agreed.

  • 6. Materials and homework

    The Tutor chooses methods and brings or recommends materials and keeps the rights in what it made. The Student does the homework agreed. A blank lists anything the Student must buy.

  • 7. Place, online lessons and safety

    A suitable, quiet, safe space. For a minor, a parent or guardian is at home or reachable. No recording without everyone’s agreement. A blank for what the Tutor can show, such as references. Either side may stop a lesson that feels unsafe.

  • 8. Minors and guardians

    Under a set age, or too young to sign alone where they live, a parent or legal guardian signs as a further party, is named in a blank, pays the fees and gets progress reports. The Tutor does not arrange meetings with a minor in secret.

  • 9. No guarantee of results

    Tutoring supports the Student and results depend on their own effort. The Tutor does not promise a grade, a pass or a school place, and is not a school and awards no qualifications.

  • 10. Personal data and recordings

    No recordings, photos or sharing of the Student’s work or details except as the safety clause allows. Contact, school and health details are used only to give lessons, shared only as needed and handled as the law requires.

  • 11. Term and termination

    Continues to an end date or until notice of a set number of days; lessons given or chargeable are paid and prepaid fees for later ones come back. A serious breach or safety concern allows ending at once. Consumer rights stay.

  • 12. Independent tutor

    The Tutor teaches as an independent person, not as an employee of the Student or the parent, decides how to teach and handles their own taxes and insurance as the law requires.

  • 13. Liability

    Each side is liable under the law. Where allowed, the Tutor’s liability for ordinary negligence is capped at an amount in a blank, never for intent, gross negligence, personal injury or unwaivable consumer rights.

  • 14. Governing law and disputes

    The law you name applies. The sides first try to settle a dispute in good faith, and otherwise the courts you name decide.

A price schedule (items, quantities and prices) is part of this contract. It starts empty, in your currency, and the clauses on fees and payment point to it.

Private Tutoring Agreement

Parties: Tutor · Student

1. Purpose

This agreement sets out the terms on which the Tutor gives private lessons to the Student. The Student may be an adult or a minor. If the Student is a minor, a parent or legal guardian also signs as a further party, as the clause on minors and guardians describes.

2. The lessons

The Tutor gives the Student lessons in the following subject or skill:

3. Schedule and attendance

The regular time of the lessons is [[Day and time]]. The parties may agree other times by message. The Student arrives on time and ready, with the materials and homework agreed.

A lesson starts and ends at the agreed times. If the Student is late, the lesson is not extended unless the Tutor can and agrees to carry on.

If the Tutor is [[15]] minutes late or more without notice, the lesson is made up or not charged.

4. Cancellation and make-up lessons

The Student may cancel or move a lesson free of charge if the notice reaches the Tutor at least [[24]] hours before it starts. After that, or if the Student does not come, the lesson is charged in full; if the Student is ill and tells the Tutor as soon as possible, the lesson is made up at no extra charge as far as the Tutor’s calendar allows.

If the Tutor has to cancel or move a lesson, for example because of illness, the Tutor tells the Student without delay and offers a make-up lesson within [[4]] weeks. A lesson that is not made up is not charged, and a fee already paid for it is refunded.

If an event beyond either party’s reasonable control, such as an official order or a failure of transport or the internet, prevents a lesson, the parties agree a new time.

5. Fees and payment

The Student, or the parent or guardian who signs (the payer), pays the fees shown in the price schedule of this contract, [[per lesson / per month / per block of lessons]], on the payment terms stated in it. The Tutor invoices or collects the fee [[at the end of each month / at the start of each block / after each lesson]].

Travel costs and materials are charged only if the price schedule lists them or the payer agreed to them in advance.

If a payment is more than [[7]] days late, the Tutor may pause the lessons after telling the payer.

6. Materials and homework

The Tutor chooses the teaching methods and brings or recommends the materials needed. Materials that the Tutor created remain the Tutor’s; the Student may use them for their own learning only and does not copy them or pass them on.

The Student does the homework and practice agreed between lessons and brings the school books, exams or tasks they want to work on.

7. Place, online lessons and safety

Lessons take place where the clause on the lessons says. Whoever hosts a lesson provides a suitable, quiet and safe space. If the Student is a minor, a parent or guardian is at home or reachable by phone during the lesson unless they agree otherwise with the Tutor.

For online lessons, each side uses a working device and connection. A lesson is not recorded unless everyone involved, and for a minor the parent or guardian, agrees in writing or in electronic form.

Either side may stop a lesson at once if they do not feel safe.

8. Minors and guardians

If the Student is under [[18]] years old, or under the age at which they can sign for themselves where they live, a parent or legal guardian also signs this agreement as a further party. The parent or guardian confirms that they have the authority to sign for the Student, agrees to the lessons, is responsible for paying the fees and receives the Tutor’s reports on attendance and progress. The Tutor does not arrange meetings with a minor Student outside the lessons agreed here without the parent or guardian knowing.

9. No guarantee of results

Tutoring supports the Student; the result depends on the Student’s own effort and circumstances. The Tutor teaches with reasonable care and skill but does not promise a particular result, such as a grade, passing an exam or a place at a school.

The Tutor is not a school, does not award qualifications and does not replace the Student’s school.

10. Personal data and recordings

Except as the clause on place, online lessons and safety allows, the Tutor does not record lessons, take photos or videos of the Student or pass the Student’s work or details to others. The Tutor uses the Student’s contact details, the information about their school and progress, and any health or learning need that the Student tells the Tutor about only to give the lessons, shares them only with people who need them for that purpose, keeps them only as long as needed and handles them as the law that applies to them requires.

11. Term and termination

This agreement starts on the effective date and continues until [[the end date / either party ends it]]. Either party may end it with [[14]] days’ notice in writing or in electronic form. Lessons given until then, and lessons that are chargeable as the clause on cancellation says, are paid for; fees paid in advance for later lessons are refunded.

If one party seriously breaches this agreement, the other may end it at once by notice. The Tutor may also end it at once if the Tutor judges that the safety of the Student or of the Tutor requires it.

Rights that the law gives the Student as a consumer, such as a right to cancel a contract made at a distance or away from business premises, are not affected.

12. Independent tutor

The Tutor teaches as an independent person and not as an employee of the Student or of the parent or guardian. The Tutor decides how to teach within the agreed schedule and is responsible for the Tutor’s own taxes, social contributions and insurance as the law that applies requires.

13. Liability

Each party is liable under the law that applies. Where the law allows a limitation, the Tutor’s liability for ordinary negligence is limited to [[the fees paid in the 12 months before the claim]]. This never limits liability for intent, gross negligence or injury to life, body or health, or any right that the law gives a consumer and that cannot be waived.

The Tutor is not liable for decisions that the Student or the parent or guardian make on the basis of the lessons.

14. Governing law and disputes

This agreement is governed by the law stated under Governing law. The parties will first try to settle any dispute in good faith. Otherwise the courts stated under Jurisdiction decide, unless mandatory law provides otherwise.

Payment terms

What it is, and what it is not

QuoteBill creates a simple electronic signature with an audit trail. In the EU, the UK, the US and Korea a signature is not denied legal effect only because it is electronic, and in Japan most contracts need no particular form at all. What a simple electronic signature proves in a dispute depends on the evidence behind it, and some documents need another form.

It is not a qualified or advanced electronic signature, and QuoteBill does not verify who the signers are. It records the use of the link and access code you delivered, so anyone who has both can sign. The signature certificate lists every link issued and, for each action by the sender or a signer, its IP address and browser where they could be read.

Some documents need another form. Wills, many real-estate transfers, guarantees and some employment documents must, in some countries, be handwritten, notarised or signed with a qualified signature. The templates are samples, not legal advice: review them with a lawyer.
