Who it is for

For a business, household or farm that hires someone for a day or a few days of paid work and wants the day, hours, daily pay and safety rules written down, with local law setting the minimum rules.

Employment law is mandatory and differs by country: minimum pay, hours, rest, minimum age, safety and social insurance are set by the law where the work is done, so get local advice first.

What it covers

  • 1. Purpose

    What the agreement is for: short-term work on the stated day or days with daily pay and no continuing obligation, with the law of the country where the work is done applying as well.

  • 2. Work and place

    Blanks for the work, the place and who gives instructions. The Employer may adjust the tasks within the Worker’s skills and what the law allows.

  • 3. Work days and hours

    Blanks for the dates, the start and finish times and the breaks. Breaks, maximum hours and pay for overtime, night and holiday work follow the law, with a blank for any extra pay.

  • 4. No continuing obligation

    The agreement covers only the stated days and ends when the work is done. Neither side has to offer or accept more work, and the law applies if it treats regular work differently.

  • 5. Pay

    Daily pay comes from the price schedule or a blank, with a blank for meals or travel. Tax and social contributions are withheld as the law requires, and a pay record is given where the law asks for one.

  • 6. Age, right to work and guardians

    The Worker confirms they are old enough and have the right to work there. Where the law needs it, a parent or guardian signs as a further party, named in a blank.

  • 7. Safety and equipment

    The Employer provides a safe workplace, tools, hazard briefing and the protective equipment and training the law requires. The Worker follows the rules and stops work if a situation is dangerous.

  • 8. Accidents and insurance

    Injuries and damage are reported at once. Accident cover is as the law requires, with a blank naming it. A blank sets the Worker’s liability for damage to the Employer’s property, as the law provides.

  • 9. Cancellation and early end

    The Worker reports an absence in the way a blank sets. If the Employer cancels or ends a day early, a blank sets what is paid, never less than the law requires. Early ending follows the local law.

  • 10. Confidentiality, property and personal data

    The Worker keeps the Employer’s confidential information secret, except public information and what the law allows or requires. Tools are returned; personal data is handled as the law requires.

  • 11. Mandatory law and written terms

    The local law gives rights this agreement cannot reduce, and applies if the agreement gives less. Where the law asks for a written contract or written terms, this agreement and an attachment supply them, in the form the law requires.

  • 12. Changes and notices

    This contract is the whole agreement apart from rights the law gives. Changes need both sides’ written or electronic agreement where the law allows that form, and notices go to the addresses stated.

  • 13. Governing law and disputes

    The law you name applies. The sides first try to settle a dispute in good faith, and otherwise the courts you name decide.

A price schedule is optional: add one if you want the amounts in a table, or write the agreed amount into the payment clause.

Day-Labour or Short-Term Work Agreement

Parties: Employer · Worker

1. Purpose

This agreement sets out the terms on which the Employer employs the Worker for the day or days of work described below. It is for short-term work with daily pay and no continuing obligation. The law of the country where the work is done also applies and may give the Worker more rights than are written here.

2. Work and place

(1) The Worker does this work: [[Description of the work]]

3. Work days and hours

4. No continuing obligation

This agreement covers only the date or dates stated above. It ends when that work is finished, and neither party has to offer or accept further work. Further work is agreed separately, on the day or in a new agreement. Where the law treats regular or repeated work differently, for example by giving the Worker more rights, that law applies.

5. Pay

(1) The Employer pays the Worker the daily pay shown in the price schedule of this contract or, if there is none, [[Daily pay and currency, e.g. 100.00 per day before tax]] for each day worked, on the payment terms stated in this contract. (2) The Employer deducts and pays the tax and social contributions that the law requires and gives the Worker a record of the pay where the law requires one.

6. Age, right to work and guardians

The Worker confirms that they are old enough to do this work under the law of the country where the work is done, that they have the right to work there, and that they will show the documents the law requires. If the Worker is under the age at which they can sign for themselves, or the law requires a parent’s or guardian’s consent for this work, a parent or legal guardian also signs this agreement as a further party. The law may not allow some work, hours or tasks for young people at all.

7. Safety and equipment

The Employer provides a workplace and tools that are safe for the work as the law requires, explains the hazards and the safety rules before the work starts, and provides the protective equipment and training that the law requires: [[Protective equipment provided, or none]]

The Worker follows the safety rules and instructions, uses the equipment only for the work, and does not do work they are not trained or allowed to do. The Worker stops work and tells the Employer at once if a situation is dangerous.

8. Accidents and insurance

The Worker tells the Employer at once about any injury, accident or damage. 9. Cancellation and early end

10. Confidentiality, property and personal data

The Worker keeps the Employer’s confidential information that they learn on the job secret, except public information and what the law allows or requires them to disclose, including reporting wrongdoing to an authority. The Worker looks after the tools and materials the Employer provides and returns them when the work ends. The Employer processes the Worker’s personal data to manage the work and as the law requires, and tells the Worker how it does so.

11. Mandatory law and written terms

The law of the country where the work is done gives the Worker rights that this agreement cannot reduce. If anything in this agreement gives the Worker less than that law requires, that law applies instead. Where that law requires a written contract or written information on the main terms, such as the days, hours and pay, this agreement and the document attached here supply it: [[Attachment, or none]] The parties add whatever is still missing. Where that law requires a particular form for the contract or the written terms, the parties also meet that form.

12. Changes and notices

This contract, including its price schedule, is the entire agreement on this work, apart from the rights the law gives. Changes are valid only if both parties agree to them in writing or in electronic form, where the law allows that form. Notices are given to the addresses stated for the parties, or to another address a party has notified.

13. Governing law and disputes

This agreement is governed by the law stated under Governing law. The parties will first try to settle any dispute in good faith. Otherwise the courts stated under Jurisdiction decide, unless mandatory law provides otherwise.

Payment terms

What it is, and what it is not

QuoteBill creates a simple electronic signature with an audit trail. In the EU, the UK, the US and Korea a signature is not denied legal effect only because it is electronic, and in Japan most contracts need no particular form at all. What a simple electronic signature proves in a dispute depends on the evidence behind it, and some documents need another form.

It is not a qualified or advanced electronic signature, and QuoteBill does not verify who the signers are. It records the use of the link and access code you delivered, so anyone who has both can sign. The signature certificate lists every link issued and, for each action by the sender or a signer, its IP address and browser where they could be read.

Some documents need another form. Wills, many real-estate transfers, guarantees and some employment documents must, in some countries, be handwritten, notarised or signed with a qualified signature. The templates are samples, not legal advice: review them with a lawyer.
